What Are Court Records

Court records can be an invaluable resource when researching information about a particular person or property. The court records show the legal history for many different situations. There are many different types of courts within the United States that can provide a myriad of information. However, this can be both a blessing and a curse because the numerous courts and filing systems make it difficult for the average researcher to access all of the information that they need. To do this manually, a researcher would have to go through each and every type of record and piece everything together. Another option is to make use of a private online service that is able to perform a complete and thorough search of all available court records.

County Court Records

The county court records is a wealth of knowledge. The county recorder's office keeps track of births, marriages, divorces, and even deaths. You can also gain access to liens on property, judgments and even the prices of recently sold real estate. While there truly is quite a bit of information to be found within the county court records, keep in mind that the staff at the recorder's office are limited by law in how much they can assist you with your search. You can ask for assistance, but don't be surprised if you are told that they are not allowed to help you with most issues. In addition, the staff are extremely busy and usually aren't the most helpful. Another option is to make use of a private online service that is able to perform a complete and thorough search of all available court records.

State Court Records

The state court records can be researched by the general public as well. Many states have their records system organized for you to search through a computer database. You can search through each case and review arrest records, judgments as well as sentencing. However, this is a time consuming process and the records available to the general public are still quite limited. Another option is to make use of a private online service that is able to perform a complete and thorough search of all available court records.

Clerk of Court

The clerk of court's office is an important resource to anyone doing research on court records. The Clerk of the Court is a locally elected official in charge of managing court records within the judicial branch of the government. The clerk of court office is where much of the manual research is done to locate both criminal and civil issues. If you are someone that does many records searches, this is the office to befriend.

Criminal Court Records

Convictions

After an arrest has been made and the suspect found guilty (by judge or trial), it is considered a criminal conviction. At this point, a conviction record is created and placed into the state's criminal record and available for the public to research. Reviewing the criminal court records will give you access to any past criminal convictions.

Arrest

As soon as an arrest is made, a file is created with the suspect and held within the police department's records. This file lists all of the details surrounding the case, starting with the police officer's initial findings at the time of arrest and any statements that the suspect made. The arrest records will contain the mug shot, which is a photo ID of the suspect, as well as personal information. The arrest report is created and filed even if charges are dropped or the suspect is found innocent in the future.

Probation

Probation is often court ordered to occur after or in lieu of incarceration in both felony and misdemeanor convictions. A researcher can check the amount of probation and if it was completed by reviewing the criminal court records. This will also be visible on a criminal record provided by a private online criminal record check.

Civil Court Records

Civil Judgments

A civil judgment is awarded when an individual loses a civil lawsuit. The judgment goes on record as the amount of money that the defendant is required to pay to the plaintiff. This civil judgment is basically proof that money is owed. It is important to be aware of any civil judgments that an individual may have prior to starting a partnership or engaging in a real estate deal. This is because an unpaid judgment can result in a lien on property after a designated time (this time period is different in each state). An individual with a judgment can also have their salary garnished and bank accounts frozen until the judgment amount is paid.

Liens

A lien is a legal stake or hold on a piece of property. When a property has a lien against it, it can not be sold without the lien holder’s approval. It is very important to research the civil court records for any liens that may be held against a property that you are purchasing, or you could be making a very costly error. Liens can be placed on a property from an unpaid judgment, municipalities (water, sanitation, code enforcement), unpaid taxes or from a lender on that property. Use caution when working in partnerships with individuals with liens against their property. All liens must be paid off prior to the sale of any real estate, so if you engage in a partnership with an individual that has many liens against them, you may end up with zero profit. In the case of Federal Tax liens, they are attached to all of the individual's properties.

Bankruptcies

Another commonly researched file type in the civil court records is a bankruptcy. The clerk will give you access to the complete file which includes the “petition for bankruptcy” and the judge's decision.

The bankruptcy petition file is full of important information such as their personal information, bank account information, employment history and benefit information. The file also informs you of any property that will be retained or surrendered.

What Are District Courts?

The district courts are the trial courts of the United States Federal Court System. This court sees both civil and criminal cases, with the inclusion of Bankruptcies. Each state has at least one district, with a total of 89 districts throughout the country and it's territories (Puerto Rico and Guam).

What Are Circuit Courts?

While many counties have smaller courts divided up by county, they generally are not able to rule on higher cases. That is where the circuit court comes in. The circuit courts are the higher authority that has jurisdiction over several counties or districts throughout the state.

What Is The Supreme Court?

In short, the Supreme Court is the last word on any hearings. This is the highest federal court in the United States, and no other judgment can trump their rulings (state or federal). The Supreme Court is made up of one Chief Justice and eight associate justices chosen directly by the Presidents of the United States. These judges meet to rule on cases of extreme importance (constitutional law or major federal issues), and only a small amount of cases per year. While the Supreme Court is traditionally secretive of their discussions, the federal government makes their rulings and information available to the public.

How To Find Court Records

Court records are available as public record for interested parties to research. The procedure for finding court records varies depending on the state or county that you are searching in but the most common method is a microfiche method. Microfiche is a very tiny piece of microfilm where important documents are imprinted, and you must place into a magnifier machine to read. Basically, it's a convenient way to store a large quantity of files in a small area. A researcher would head down to the courthouse and search through their microfiche collection. The information is stored on these tiny strips and can be reviewed by slowly scanning from left to right. More modern court houses have begun to place this information on a computer database, making it a little bit easier to access records. However, this is not customary and the bulk of the information is still usually stored on microfiche. The easiest and most efficient method is to make use of a private online service. An online service gathers the information from several databases and puts everything together in an easy to read package, unlike what one must go through when searching through thousands of microfiche files.
