What Is A Warrant?


A warrant is a document signed off by a judge, that allows a law enforcement officer to take a particular action. In the case of an arrest warrant, having one of these issued in your name is an automatic ticket to jail – Do Not Pass Go – Do Not Collect $200 – Go Directly To Jail!


What Are The Different Types Of Warrants?


A warrant can be placed against you for numerous reasons. The three most common types of warrants are: Search Warrants, Arrest Warrants, and Bench Warrants. We will go into more detail of each warrant type below.


What is a Search Warrant?


A search warrant is an order signed by a judge that gives police officers the right to search for specified items at a specified location, and at a specified time. For example, a search warrant may allow the police to search “the entire premises of 123 Nice Street, between the hours of 7am and 10pm” to search for “narcotics, weapons, and cash”. The police department must follow this order exactly as prescribed or their evidence will be inadmissible in court. If you are served with a search warrant, it is important to carefully read the document Always keep in mind that the police can only search the premises listed on the order at the exact time. Usually, they can only seize the items listed on the warrant as well.


What is a Bench Warrant?


This is the most common type of active warrant. A bench warrant is placed on a person for a “non appearance”. If you are sent a notice to appear in court and don't show up, then you will have what is called a bench warrant placed against you. That is why it's so important not to ever miss a court date, no matter what the circumstances. A warrant is a problem that will haunt you until it's taken care of. Even worse yet, you can be charged with additional crimes such as “bail jumping”, even if bail was never set.

Even worse, you will look unfavorably to the judge because the officer will put on your record that you were taken in involuntarily.


Do arrest or bench warrants expire?


Unfortunately, arrest warrants, including bench warrants do not ever expire. There is no statute of limitations for these types of warrants in the United States. The only action that will clear a bench warrant is death or the defendant's appearance in the court that issued the warrant. In other words, active warrants stay active forever.


I Have An Active Warrant Against Me – What Do I Do?


Option One - you can just wait and do absolutely nothing. If this is a warrant for a lower crime, there is a chance that local police enforcement will not come looking for you. However, you will always be looking over your shoulder and can be dragged to jail for a simple traffic stop. As described in the example above, you can even be arrested after providing information on a job application.


Option Two - Since a warrant never expires on it's own, we suggest a second option. Remember that having an outstanding warrant is a legal problem that will follow you until it's dealt with. That is why we recommend that you contact an attorney first and then present yourself in front of a judge. Never, under ANY circumstances turn yourself in directly to a police officer. If you and your attorney are able to present a reasonable case to the judge, there is a chance that they will remove the bond and allow you to have a trial at a later date.

This can be done by searching through the records at your local Sheriff's department or by simply doing an online background check on yourself.
